General terms and conditions of the online media library of Saumur Val de Loire Tourisme
The consultation and the use of pictures, videos and other data provided by Saumur Loire Valley Tourism on its website https://media.ot-saumur.fr/ involve the full and complete acceptance of these conditions:
These terms and conditions are expressly subject to the provisions of the Code of Intellectual Property.
The photographs, videos and any other material obtained through the media library cannot under any circumstances be used for commercial purposes (postcards, advertisements, posters, etc.).
Any total or partial reproduction of this site by any process whatsoever, without the express permission of Saumur Val de Loire Tourisme, is prohibited and constitutes an infringement sanctioned by articles L.335-2 and following of the Code of Intellectual property.
ACCESS TO THE MEDIA LIBRARY
All users have free access to the media library. As all the visuals are not copyright-free for all categories of borrowers, access codes to the library will be assigned to the borrowers based on their rights.
Users can have access to the media library and to certain elements of the content, as determined by Saumur Val de Loire Tourisme, without registration or have access to other content items, as determined by Saumur Val de Loire Tourisme, by previously creating an account, under the following conditions:
Access without registration
Any user accessing the library without registration can view and download a limited and predefined selection of photographs or videos, selected by Saumur Val de Loire Tourisme, for personal use. The downloaded media will necessarily have an embedded watermark and will not exceed 1280 pixels.
Access with registration
Any user wishing to have, under the conditions below, a more extensive access to the content of the media library must create an account. In order to do this, users must apply for registration via the tab "Registration", by filling in all the form fields provided for this purpose. The creation of an account will only be effective after approval by Saumur Val de Loire Tourisme of the registration request concerned.
Saumur Val de Loire Tourisme reserves the right to refuse any application for registration of their choice, without reason and with notice to the user concerned.
There are different categories of users, as listed below, for the creation of an account:
- TO Team
- Press
- TO/AV
- Advertising Agency
- Institutional partner
- Provider
- Other
When creating an account, users will have to fill in the following fields: Title, name, first name, name of institution, category (drop-down list: all groups), email, address, zip code, city, country, password, password confirmation, intended use.
The scope of the rights granted to users on the content varies depending on the category to which the users belong, after the creation of their account as detailed below.
If Saumur Loire Valley Tourism validates the registration request of a user, the user’s account will be created and the user will receive an email confirmation of registration, which will then allow him/her access to the concerned content, depending on the user category to which he/she belongs, through the media library.
Saumur Val de Loire Tourisme reserves the right to close any account where the information entered by the user in question would appear erroneous, incorrect or expired.
ACCOUNT INFORMATION
The username and password are personal to the user.
In order to respect the confidentiality of their ID and password, users agree not to transmit, for any reason whatsoever, to any third party their ID and password and agree to immediately notify Saumur Val de Loire Tourisme in case of real or suspected loss and/or theft of these particulars.
In the event of users losing their password, they are prompted to click on the link " Forgot your password ". Their password will then be sent by email to the address on their ID as soon as possible.
Users are solely responsible for all the information they provide on their profile when creating an account.
Users remain solely responsible for any damage that they are likely to suffer or cause due to inaccurate, incomplete and/or misleading information that they may have provided when creating an account or in the absence of updating of such information. Saumur Val de Loire Tourisme will in no event be liable concerning this.
AUTHORIZED USE OF DATA OF THE MEDIA LIBRARY - MANDATORY PHOTO CREDIT
The visuals presented on the website https://media.ot-saumur.fr/ are exclusively for free distribution, be it for the press, internet or any other mode of communication.
Uses for commercial editions (postcards, commercial advertisements, posters ...) and displays with media buying are excluded.
Rights excluded: any other use must be subject to separate negotiation with the photographer, including: Advertising with media buying.
Users undertake to mention in all cases, in visible, apparent characters and contiguously to each visual, the credits "Saumur Val de Loire Tourisme" and the name of the author of the visual concerned, as follows: "© name of photographer – Saumur Val de Loire Tourisme".
Moreover, users must undertake to respect all indications and restrictions specified in the captions of the photographs on the media library website.
Saumur Val de Loire Tourisme holds the rights to use the photographs lent as such. However, they assume no responsibility for any action, suit, claim or application from any person, including with regard to the image rights of the person, against the production, reproduction, publication, telecommunication and broadcast to the public by users, of one or more photographs that they may have reframed or otherwise altered.
Any production of duplicates of the photographs by users or by third parties is strictly prohibited.
It is strictly forbidden to modify, in any way, the photographs, videos and documents which are downloaded, unless with prior agreement with Saumur Val de Loire Tourisme and written permission from them.
The data (pictures, videos and other documents) obtained through the media library should be used only according to the rights that have been granted. It is especially forbidden for users to transfer or republish the photographs they have downloaded unless they have a written permission from Saumur Val de Loire Tourisme.
EVIDENCE OF PUBLICATION
Users undertake to send evidence of publication to Saumur Val de Loire Tourisme – 8a Quai Carnot – CS 54032 – 49415 Saumur Cedex or by mail to media@ot-saumur.fr indicating the link of the website where the photographs are being used.
DURATION AND TERMINATION
DURATION
The present Terms and Conditions are concluded for an indefinite period from the date of acceptance by users.
Termination
Users may terminate these Terms and Conditions at any time without notice by deleting their accounts and/or stopping to use the media library.
In case of non-compliance with one or more of the obligations of these Terms and Conditions by users and without prejudice to any civil and/or criminal penalties applicable because of any violation of third party rights that might incur these users, Saumur Val de Loire Tourisme reserves the right to terminate immediately, automatically and without prior notice, these Terms and Conditions with the users and therefore remove access by those users to the media library, including suspend or immediately close their accounts and prevent access by those users, without prejudice to any damages that Saumur Val de Loire Tourisme could claim.
UPDATE AND DEVELOPMENT OF TERMS AND CONDITIONS
Saumur Val de Loire Tourisme reserves the right to modify all or part of these Terms and Conditions at any time without notice.
In that case, Saumur Val de Loire Tourisme will notify users of any changes to these Terms and Conditions as soon as they are released on line in the media library, by email or via the media library.
In case of refusal to agree with the new Terms and Conditions, users have a period of twenty-four (24) hours from the date of notification to inform Saumur Val de Loire Tourisme by e-mail about their decision.
If users have not notified their disagreement within the period provided above, they will be deemed to have accepted the changes and any use by users of the media library will be governed by the new Terms and Conditions.
GENERAL DATA PROTECTION REGULATIONS (GDPR)
The General Regulation on Data Protection (RGPD), new regulations at European level, entered into force on 25 May 2018. Personal data correspond to "any information relating to an individual or identifiable individual." Is deemed to be an "identifiable natural person" a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an on-line identifier, or to one or more elements specific to their physical, physiological, genetic, psychic, economic, cultural or social identity.
The personal data that the user will have to provide to Saumur Val de Loire Tourisme on the media library's website in order to respond to requests for details or information in connection with the opening of an account will be collected and processed fairly and lawfully and will only be used as part of the management of the library.
All users are therefore entitled to download or delete their personal data when they wish, Saumur Val de Loire Tourisme being thus obliged to remove all personal data concerning them. In order to do so, users can go to the "My Account” section, accessible once connected.
APPLICABLE LAW, JURISDICTION AND CONTRACTUAL DOCUMENTS
These General Terms of Use are governed by French law. Any improper use of the conditions of use of the media library of Saumur Val de Loire Tourisme may be subject to prosecution before the competent courts.
